All returns/cancelled orders are subject to a 20% restocking fee and return shipping charges. Shipping and fees are nonrefundable.

Magazines that violate capacity laws will not be shipped, substituted or discounts given due to lack thereof.

Black Market Arms LLC uses stock photos for listings. Styles, accessories, and specifications vary and are subject to change without notice from the manufacturer. (EX. magazine count, cleaning kits, locks, etc) Please refer to manufacturer’s website for specifications. If an item is deemed no longer legal per ATF rulings (past pistol brace ban as an example), BMA reserves the right to remove the banned features prior to shipping. These changes do not constitute an approval for return.

Shipping to HAWAII, ALASKA, and U.S. TERRITORIES may require up to $50 additional shipping.

All orders are shipped promptly from our warehouse or in-store inventory within 3-10 Business days upon receiving payment & verified FFL information. Tracking numbers will be emailed to you once your items ship. The expected delivery date does not come with a money-back guarantee.

SHIPPING TO CALIFORNIA

Due to recent changes in California law (including AB 1263 and related legislation) that impose significant new requirements on the sale, transfer, and shipping of firearms, firearm parts, accessories, and related products to California residents, all items shipping to California must ship to an FFL, subject to standard verification and compliance with all applicable federal and state laws. Once an order is placed Black Market Arms will provide you compliance form to fill out. This form must be completed and returned with the receiving FFL’s information or your order will be cancelled.

CALIFORNIA TRANSFER REQUIREMENT:

All items shipping to CA must be shipped to a valid FFL holder for transfer, even for exempt customers. Direct shipments to non-FFL addresses in California are prohibited, regardless of the product purchased.

We regret any inconvenience this may cause and recommend California customers consult local FFL dealers or legal counsel for alternatives. This policy is implemented to ensure full compliance with evolving California regulations.

Shipping and Delivery; Risk of Loss

Once your order is shipped, title to the products and risk of loss pass to you upon our delivery of the merchandise to the carrier. Delivery is considered complete and successful when the carrier provides confirmation of delivery to the shipping address you provided at checkout. This includes (but is not limited to) a delivery scan, signature confirmation, photo proof, or any other status update from the carrier indicating the package has been delivered (e.g., left at front door, porch, mailbox, mailroom, parcel locker, or with a neighbor).

Black Market Arms LLC is not responsible for any package that the carrier marks as “delivered” but that you claim was not received, lost, stolen, or otherwise missing after delivery confirmation. In such cases:

• You agree that carrier delivery confirmation constitutes conclusive proof of delivery.
• You are solely responsible for filing any claim directly with the shipping carrier (USPS, UPS, FedEx, etc.) and/or your local law enforcement if theft is suspected.
• We will provide reasonable assistance, such as supplying tracking information, order details, or supporting documentation for your claim, but we are under no obligation to issue a refund, replacement, or credit.

You are responsible for providing a complete and accurate shipping address. We are not liable for orders shipped to incorrect or incomplete addresses.

By placing an order, you acknowledge and agree to these terms.

Abandoned Orders, In-Store Pickup, and Returned Shipments Policy

We make every reasonable effort to contact customers regarding order pickup or delivery issues using the email and phone number provided at checkout. It is the customer’s responsibility to maintain accurate contact information and respond promptly.

1. In-Store Pickup Orders

All in-store pickup orders must be picked up within 30 calendar days of the date we notify you that the order is ready (via email or phone).

• Storage Fees: If the order is not picked up within the initial 30-day period, a storage fee of $10.00 per day (per order, regardless of quantity) will begin accruing on day 31. Storage fees are due at the time of pickup.

Abandonment: We will attempt to contact you multiple times if the order remains unclaimed. If storage fees accumulate to equal or exceed the total order amount (including taxes and original shipping/handling), the order will be considered abandoned. At that point:

• You forfeit any right to a refund.
• The items may be placed into our inventory for resale, disposed of, or otherwise handled in accordance with applicable law.

Prior arrangements for extended storage beyond 30 days must be made in writing and approved by us; otherwise, standard fees apply.

2. Returned-to-Sender (RTS) or Undeliverable Shipments

If a shipped order is returned to us by the carrier (for any reason including refusal, incorrect address, no response to delivery attempts, or inability to contact the recipient), we will attempt to contact you to arrange redelivery or pickup.

• You will have 30 calendar days from the date the package is returned to us to respond and pay any additional reshipment charges.
• If no response is received within 30 days, the order will be canceled and processed as abandoned.

Refund Calculation (if any):

• Original shipping charges are non-refundable.
• Return shipping costs (RTS fees) will be deducted from any refund, including those that had free shipping.
• A 20% restocking fee on the merchandise subtotal will be deducted.
• Credit card processing fees (typically 3%) incurred on the original transaction will be deducted.
• The remaining balance will be refunded to the original payment method.

We will never ship a second time without your explicit approval and payment of all additional charges. Refusing delivery or failing to respond does not constitute a valid return under our standard Returns Policy and will result in the deductions outlined above.

General Provisions

• This policy applies to all orders placed on our website or through GunBroker.
• All fees and forfeitures are in addition to any applicable state or federal laws regarding unclaimed or abandoned property.
• We reserve the right to charge storage or restocking fees immediately in cases of repeated no-shows or bad-faith orders.
• Customers with special circumstances (military deployment, medical issues, etc.) should contact us before the deadlines to request an exception.

Shipping Rates & Large-Volume Orders

Advertised Standard Shipping Rates: These rates are designed to cover typical single- or small-quantity orders. However, because actual shipping costs depend on the specific products’ weight, dimensions, packaging requirements, destination, and carrier rates, unusually large or bulky orders (for example, 5+ firearms or high-volume accessory orders) may incur additional shipping charges.

If your order falls into this category, we will contact you before processing or charging any extra amount to provide the actual shipping quote and obtain your approval. You will have the option to:

• Pay the additional shipping and proceed,
• Cancel the order for a full refund.

We will never ship without your explicit agreement to any additional charges. Orders requiring special handling (oversized boxes, hazmat-compliant packaging for certain accessories, etc.) are evaluated on a case-by-case basis.

PAYMENT AND CHARGEBACK POLICY

By bidding, purchasing, or completing checkout, the Buyer agrees to all terms in this listing and certifies they have read and understand them.

Chargeback / Payment Dispute Reimbursement:

If the Buyer initiates a chargeback, reversal, refund request, or dispute (with their credit card issuer, bank, payment processor, or via GunBroker’s BPP) that violates these terms—including but not limited to buyer remorse, failure to follow FFL/shipping instructions, non-acceptance of an “as-is” item after inspection at the FFL, or any situation where the sale complies with the listed terms—the Buyer agrees to reimburse Black Market Arms LLC for:

• The full amount of any chargeback fee or reversal fee charged by the processor or bank (50 per incident, plus any increases);
• Restocking fees, return shipping, or other costs outlined in our Return Policy;
• Reasonable collection costs, attorney fees, and expenses incurred in defending or recovering the disputed amount.

Black Market Arms LLC reserves the right to pursue collection of these amounts through all available legal means, including reporting the matter to involved third parties and relevant authorities. Buyer agrees that these terms form part of the binding sales contract.

GOVERNING LAW, VENUE, AND DISPUTE RESOLUTION

This sales contract, including these Additional Terms of Sale, shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of laws principles.

By bidding on, purchasing, or completing checkout for this item, the Buyer irrevocably agrees that any and all disputes, claims, controversies, or legal actions arising out of or relating to this transaction—including but not limited to chargebacks, payment reversals, refund requests, Buyer’s Protection Program claims, breach of contract, or any other issues—shall be brought exclusively in the state or federal courts located in Callaway County, Missouri.

Buyer expressly consents to the personal jurisdiction of these courts and waives any objection to venue or jurisdiction in Callaway County, Missouri. Buyer further agrees to reimburse Black Market Arms LLC for all costs, expenses, and attorney fees incurred in enforcing this provision or defending any action brought in violation of it. This forum selection clause applies in addition to the Chargeback / Payment Dispute Reimbursement section above.

FIREARM RETURNS

30-DAY RETURN POLICY

No merchandise will be accepted for return without a Return Authorization Form obtained from Black Market Arms LLC. All returns must include a copy of the original purchase receipt or invoice and are subject to a 20% restocking fee. Shipping, return shipping, and all associated fees are non-refundable.

Items are not eligible for return if they have been used, altered, or are not in their original packaging with all manuals, instructions, and accessories.

Black Market Arms LLC does not accept returns on non-defective products under any circumstances.

Pricing & Item Errors

Black Market Arms LLC reserves the right to cancel any order and issue a full refund if a system error results in an incorrect price. If you receive an incorrect item due to a system error, we will provide a return shipping label and ship the correct item if available. If the correct item is not available, we will issue a full refund upon receipt and inspection of the returned merchandise.

It is the buyer’s responsibility to thoroughly inspect all firearms for discrepancies before accepting transfer and taking possession.

Defective Items

All items are shipped exactly as received from the manufacturer and are typically covered by the manufacturer’s warranty. If your item arrives defective, missing parts, or damaged out of the box, you must contact the manufacturer directly for warranty service or replacement. We are not a warranty station and do not perform repairs or replacements.

Firearms

By purchasing a firearm or firearm receiver from Black Market Arms LLC, you agree that it must ship to a licensed FFL dealer. Firearms cannot be returned once transferred into your possession, as they are then considered used. If a background check is denied or the firearm is not picked up from the FFL, you will be subject to restocking fees.

Any defect discovered after transfer must be handled directly with the manufacturer under their warranty policy. Manufacturer-repaired or replaced firearms can be shipped directly back to you without requiring an additional FFL transfer.

Please take your time to inspect all firearms thoroughly before proceeding with the transfer. Once a new firearm is transferred to you, it is considered used, even if not fired. Consequently, we cannot accept returns on firearms once they have been transferred into your possession. If a defect is discovered after the transfer, the firearm MUST be returned directly to the manufacturer for replacement or repair (in accordance with manufacturer’s warranty policy). Manufacturer repaired firearms can be returned directly to the customer without additional FFL transfer or associated fees.

ACCESSORY RETURNS

Accessory Returns

Black Market Arms LLC does not accept returns on accessories unless we grossly misrepresented the item or shipped the wrong one. Most accessories carry a manufacturer warranty. Please contact the manufacturer directly for any issues after installation.

AMMUNITION 

Ammo can only be shipped to the lower 48 states where legal. Some states may require ammunition be shipped to an FFL dealer in your area for transfer or may require a permit. Please inquire prior to purchase about your state’s requirements.
